General terms of sale
1. Seller identification. GAIA AGROTECH VENTURES, S.L. (“Mas Climent”), registered at Avenida Diagonal, 640, 4th floor, Local E, 08017 Barcelona (Spain), tax ID B13944699, is the seller of the products offered on this website. Contact: info@mascliment.com.
2. Acceptance, minimum age and consumer status. These General Terms of Sale (“GTS”) govern purchases made through the Mas Climent website. By placing an order, the user expressly accepts their entire content, declares they have legal capacity to contract and act as a consumer under article 3.1 of the Spanish General Law for the Defence of Consumers and Users (“LGDCU”).
Sale of alcoholic drinks: buying alcoholic drinks is reserved to people over 18. When placing an order that includes them, the customer declares they are of legal age and undertakes that delivery will also be received by an adult. Mas Climent may take reasonable steps to verify age and, if it cannot be established, may refuse delivery.
The GTS in force at any time are permanently available on the website for consultation, download and printing, before the purchase (pre-contractual information under art. 97 LGDCU). Each order is governed by the GTS in force when it is accepted.
3. Products and purchase process. Mas Climent sells wine, olive oil, honey and other food products. Each product page includes the information required by applicable law (name, ingredients, allergens, net quantity, storage, nutritional information, origin and, where applicable, alcoholic strength and volume). Images are illustrative; Mas Climent endeavours to keep product information up to date.
The customer selects the products and completes the order form, accepting the GTS and the Privacy Policy. After payment, the contract is deemed formed when Mas Climent sends a confirmation email, which includes or gives access to the order summary and the applicable GTS. Mas Climent may decline the order in case of problems with availability, payment, delivery details or age verification.
4. Price and availability. Prices are in euros and include the applicable VAT; shipping costs are calculated at checkout. Mas Climent may change prices at any time, without affecting orders already accepted and confirmed.
Offers are valid while published and subject to stock. The number of bottles per customer may be limited. If a product is unavailable, Mas Climent may propose an equivalent substitute, which only applies with the customer's express acceptance; otherwise the corresponding amount is refunded within a maximum of 72 hours.
5. Payment. Payment is made through the Shopify and PayPal gateways and is charged when the order is accepted, subject to authorisation by the relevant institution. Mas Climent has no access to and does not store the customer's banking data. An invoice is issued, electronically unless expressly objected to, when the customer requests it.
6. Delivery. Mas Climent ships within Spain, with an estimated time of 5 to 7 business days from order confirmation, unless a different time is stated for a specific product or destination. The customer must provide a correct and complete delivery address; if delivery cannot be made for reasons attributable to the customer (including the impossibility of verifying legal age), Mas Climent will get in touch to arrange a new delivery or the return.
7. Right of withdrawal and returns. A customer who qualifies as a consumer may withdraw from the contract within 14 calendar days of receiving the product, without giving reasons, except for the direct costs of return where they have been informed these are at their expense. To exercise it, they must give unequivocal notice to info@mascliment.com or by post to Avenida Diagonal, 640, 4th floor, Local E, 08017 Barcelona, and may use (optionally) the model form in Annex I.
Mas Climent refunds all payments, including ordinary delivery costs, within a maximum of 14 calendar days from notice of withdrawal, and may withhold the refund until the products are received or proof of their return is provided. The customer must return the products within a maximum of 14 calendar days from giving notice of their decision.
The right of withdrawal does not apply to goods liable to deteriorate or expire rapidly, or to sealed goods unsuitable for return for health or hygiene reasons that have been unsealed. Merely opening the outer packaging does not in itself exclude this right; the customer is only liable for any diminished value resulting from handling beyond what is necessary to check the product.
8. Damaged, incorrect or non-conforming products — legal guarantee. If a product arrives damaged, incorrect, incomplete or non-conforming, the customer must report it to info@mascliment.com stating the order number and, if possible, photographs of the issue. Mas Climent will proceed with replacement, repair, price reduction or refund in accordance with applicable law.
All products carry the 3-year legal guarantee of conformity from delivery provided in art. 120 LGDCU; these GTS in no way limit the consumer's legal rights.
9. Other provisions. If any clause of these GTS is declared void or ineffective, this does not affect the validity of the rest. Intellectual and industrial property rights in the website are governed by the Mas Climent Legal Notice.
These GTS are governed by Spanish law. Where the customer is a consumer, any dispute is submitted to the courts having jurisdiction under applicable mandatory rules.
